There are several misconceptions in Personal Injury law. Unfortunately, Personal Injury Law - law involving car accidents and people being injured - is a field that most people know very little about. Education is power. The more you know, the more you understand your rights and know what to expect if you have been injured.
One of the biggest misconceptions is this: I got hit. I get my money right away...right??
Most people do not realize that a personal injury case is a long process. The cases take from 3-6 months to 3-4 years depending on the facts. Why does it take so long? The insurance companies want proof that you are actually hurt, that you have been injured from the car crash. How do they get that proof? From your treating with the doctor. Depending on the severity of the injuries, you might need minor treatment with chiropractic care and MRI's or you might need a full-blown surgery with follow-up rehabilitation. All of this treatment takes time. Once your treatment is done, then your attorney will gather up all the medical records and bills and negotiate with the insurance adjuster. If the negotiations are successful, the insurance cuts a check, your attorney pays all the bills from that check, and then you receive the rest. If negotiations with the insurance company for your car accident are not successful, then the case has to be litigated. This could drag the process out for a couple years. It may even go to trial where a jury will decide the outcome. The key to remember is patience! Your number one priority is to get better and heal from the accident.
